I have certainly noticed that this is becoming an issue in IT. I think some of this has to do with come companies have a problem with breaches, others it is just all about protecting themselves. 

Makes sense to me, until you get to the point where it becomes part of an IT professional's job. It should not be part of their job, yet because it is related it gets lumped in, especially at the management level, which really should be handled by lawyers.

Having been burned by terms forced down my company's throat, I am now pushing back agressively on terms. I haven't used contract terms as a reason to not do business with a particular vendor, but I can see that as a definite possibility.

Where innovation goes to die
One of our speakers at the InformationWeek conference this year described legal and procurement as where innovation goes to die. Great ideas die when the legal terms can't be worked out. I certainly hear this from other IT leaders. Do you tell vendors when you walk away due to onerous legalese in agreements, readers?
