The radio doesn't care when you stop listening and the passenger will likely be aware of the situation so that a non-reply is understood. The person on the other phone doesn't know that.
Besides that, talking isn't the issue. What goes these days as 'hands-free' is nothing more than a bluetooth ear piece, but people still dial by hand or press the receive button to accept the call. Hands-free would require something with voice control and many cell phones don't have that.

Closing a deal at high speed is more important. :) Honestly though, I think a ban on hands-free is definitely overkill...should we also ban radios? Talking with your wife/girlfriend while on the road? And if the issue is cell phones then what difference does it make if you have a phone system built into the car?
