Two civil liberties groups are suing the Department of Justice in their quest to see records that would reveal how far the tracking of cell phone users has gone.Late November, the American Civil Liberties Union (ACLU) filed a request for information under the Freedom of Information Act, but has yet to see any documentation. Together with the Electronic Frontier Foundation (EFF), the organizations say "information now in the public domain suggests that [the DOJ] may be engaging in unauthorized and potentially unconstitutional tracking of individuals through their mobile phones." They are asking for a more detailed understanding of the agency's policies and procedures for allowing federal officials to do so.
U.S. attorneys have been bypassing the need to obtain court-ordered warrants to track cell phone users, instead going straight to mobile operators, the groups say. A DOJ spokesman declined to comment on the lawsuit.PC World
